Terms of Service

Article 1. Scope

These Terms apply to the use of the TIKITAKA FTG online store and related services operated by PANG DA LIMITED (胖達有限公司; hereinafter, the Store).

Transaction-specific terms for purchases are set out on the product page at the time of order and at checkout, as well as in Disclosure under Japan’s Act on Specified Commercial Transactions, Shipping Policy, Refund Policy; these terms form part of the contract. If these Terms conflict with the transaction-specific terms, the transaction-specific terms govern that transaction.

Article 2. User Responsibilities

Users must register and provide accurate information and properly safeguard their accounts and authentication credentials. Minors must obtain consent from a legal representative where required by law before using the service.

Article 3. Prohibited Conduct

• Conduct that violates laws or public order and morals; fraud; unauthorized payment; providing false information; or impersonation
• Infringing the intellectual property, privacy, or other rights or interests of the Store or a third party
• Unauthorized access, transmitting harmful programs, or placing an excessive load on the system
• Threats, discriminatory language or conduct, persistent harassment, or other conduct that unfairly interferes with the Store’s business or another person’s use of the service

Good-faith inquiries and complaints, and the exercise of rights under the law, are not prohibited conduct.

Article 4. Intellectual Property Rights

Rights in the text, images, logos, and other content on this site belong to the Store or the respective rights holders. Users may not reproduce, copy, modify, commercially use, or otherwise use that content without authorization beyond what the law permits.

Rights in content posted by users remain with the users or other rights holders. The Store may use such content only to the extent necessary to publish and display it on the service where it was posted. Users must hold the rights and permissions needed for that use.

Article 5. Personal Information

Personal information is handled in accordance with our Privacy Policy.

Article 6. Suspension or Change of the Service

The Store may suspend or change all or part of the service for reasonable reasons, including maintenance, outages, security needs, or disasters. We will give advance notice where practicable and notice afterward in emergencies. Contractual obligations under contracts already formed will be performed in accordance with the law.

Article 7. Use Restrictions and Refusal of Orders

Where there are reasonable grounds, such as a violation of these Terms, misuse, or a material error in information, the Store may restrict use or refuse an order to the extent necessary. Any termination of a contract that has already been formed will follow the law and the contract, and we will notify the user, including how any amounts received will be handled.

Article 8. Disclaimers and Scope of Liability

The Store makes no warranty beyond matters specifically promised or required by law regarding service continuity or fitness for a user’s particular purpose. The Store is not responsible for losses caused by communication failures, third-party interference, force majeure, or similar events not attributable to the Store, except where liability is required by law.

To the extent permitted by applicable law and considered reasonable, the Store’s liability for damages caused by ordinary negligence is limited to ordinary and direct losses and capped at the total product price the user paid the Store for the transaction that gave rise to the claim. This cap applies only to product transactions for which a product price was paid; it does not apply if there was no such transaction or payment. Lost profits, indirect losses, and special damages are excluded.

The above limitations do not apply to the Store’s willful misconduct or gross negligence, injury to life or body, liability relating to goods where exclusion or limitation is not permitted by law, or other liability that cannot be limited. These Terms do not limit user rights under applicable consumer-protection laws or other mandatory rules.

Article 9. Changes to These Terms

The Store may change these Terms within the scope and through the procedures permitted by law. We will announce the changes and their effective date in advance on this site or elsewhere and follow the required process where individual consent is needed.

Article 10. Governing Law and Jurisdiction

These Terms and sales contracts with the Store are governed by and interpreted in accordance with the laws of the Hong Kong Special Administrative Region. This does not exclude the protection of mandatory provisions that apply under the laws of Japan or another place where the customer habitually resides.

The courts of the Hong Kong Special Administrative Region have exclusive agreed jurisdiction at first instance over disputes concerning these Terms and sales contracts with the Store. For consumer contracts, however, if the effect of this jurisdiction agreement is limited by the laws of Japan or other applicable law, those laws apply.

Article 11. Severability

If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
